UPDATE: The New Notarization Regulations Are Now Officially Published

The full text of Ministry of Justice Decision No. 590 of 2026, the Executive Regulations of the Notarization Law No. 10 of 2020 as amended by Decree-Law No. 147 of 2025, has been published in Kuwait Al-Youm Issue 1809 of Sunday 20 September 2026. WEFAQ reported on the Decision from a certified copy when it was issued on 28 July, and the gazetted text confirms that reporting.

Publication does not move the start date. Article 3 of the Decision makes it effective from its issue date, so the rules have applied since 28 July 2026. What publication adds is the authoritative version: the gazette text, with its schedules, is now the version courts, banks and counterparties will cite.

The published text confirms the framework as reported. The old regulations, Decision No. 348 of 2021, are repealed. Notarization and attestation can run through the Ministry's electronic system, by recorded video session or, for the routine powers of attorney listed in Schedule 1, through a fully automated track with no notary intervention, with remote channels closed to persons aged seventy-five or above, persons with mental disability and those under judicial assistance. Notarized powers of attorney are valid for five years, or ten years for the excepted categories, and the licensed private notary profession stands on the published conditions: a two-year renewable licence, at least ten years of legal experience and annual professional indemnity cover of no less than KD 100,000.

WEFAQ's view: anyone who was waiting for official publication before acting on the July rules has no reason left to wait. Review existing powers of attorney against the five-year validity limit and update signing and verification procedures for the electronic track.
